Welcome to Reactive Wallpaper. These Terms of Service ("Terms") govern your use of the Reactive Wallpaper application for macOS and the website at reactivewallpaper.com (together, the "Service"). By downloading, installing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

Reactive Wallpaper is developed and operated by Saither (saither.com), an individual developer business. References to "we," "us," or "our" refer to Saither.

1. License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to use Reactive Wallpaper on your personal macOS device(s) in accordance with these Terms.

• Free tier: You may use the free version of Reactive Wallpaper on a single device at no charge, with access to the included free wallpapers.
• Pro license: Each license serial number activates Pro features on one (1) device at a time. You may transfer your license to a different device by deactivating it on the current device first.
• You may not share, redistribute, sublicense, or sell your serial number to any third party.
• We reserve the right to revoke license keys that are found to be shared or used fraudulently.

2. Acceptable Use

You agree not to:

• Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the application or its Metal shaders.
• Modify, adapt, translate, or create derivative works based on the Service.
• Remove, alter, or obscure any copyright, trademark, or proprietary notices in the application.
• Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
• Attempt to circumvent, disable, or interfere with the licensing or activation system.
• Share or distribute your license serial number publicly or with unauthorized parties.

3. Payment Terms

All payments for Reactive Wallpaper Pro are processed through Paddle (paddle.com), which acts as the Merchant of Record for all transactions. This means Paddle handles billing, payment processing, sales tax, and VAT on our behalf.

• Lifetime purchase: Reactive Wallpaper Pro is sold as a single one-time payment that grants permanent Pro access. There are no recurring charges.
• Prices are listed in USD and may vary by region due to Paddle's localized pricing. Applicable taxes are calculated and collected by Paddle at checkout.
• We reserve the right to change pricing at any time. Price changes will not affect completed purchases.

4. Refund Policy

We offer a 7-day money-back guarantee on all purchases.

• If you are not satisfied with Reactive Wallpaper for any reason, contact us within 7 days of your purchase date and we will issue a full refund, no questions asked.
• Refund requests should be sent to support@reactivewallpaper.com and must include your purchase email address or order number.
• After the 7-day window, refunds are handled on a case-by-case basis at our discretion.
• Upon refund, your Pro license will be deactivated.

5. Intellectual Property

All content included in the Service -- including but not limited to the application code, Metal shaders, visual designs, logos, trademarks, wallpaper effects, and website content -- is the intellectual property of Saither and is protected by applicable copyright and intellectual property laws.

• Your purchase grants you a license to use the software. It does not transfer any ownership of intellectual property to you.
• The wallpaper effects and shaders are proprietary. You may not extract, copy, or reuse them in other products or projects.
• You may share screenshots or recordings of wallpapers running on your desktop for personal, editorial, or social media use.

6. Warranty Disclaimer

Reactive Wallpaper is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory. We do not warrant that:

• The Service will meet all of your requirements or expectations.
• The Service will be uninterrupted, timely, secure, or error-free.
• The results obtained from using the Service will be accurate or reliable.
• Any defects in the Service will be corrected in a specific timeframe.

We strive to keep the application stable and performant, but we cannot guarantee compatibility with every macOS configuration, third-party software, or future operating system updates.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Saither shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, use, or goodwill, arising out of or in connection with your use of the Service, regardless of the cause of action or the theory of liability.

In no event shall our total aggregate liability exceed the amount you have paid to us for the Service in the twelve (12) months preceding the event giving rise to the claim, or fifty US dollars ($50), whichever is greater.

8. Termination

You may stop using the Service at any time by uninstalling the application.

• We may suspend or terminate your access to the Service if you violate these Terms, engage in fraudulent activity, or abuse the licensing system.
• Upon termination, your license to use the Service ends immediately. Provisions that by their nature should survive termination (including intellectual property, warranty disclaimers, and limitation of liability) will continue to apply.
• If we terminate your access without cause, any remedy or refund will be handled in accordance with our Refund Policy and applicable consumer law.

9. Updates and Changes

We may update the application from time to time to add features, fix bugs, or improve performance. We may also update these Terms. If we make material changes, we will notify you by posting the updated Terms on our website with a new effective date. Your continued use of the Service after such changes constitutes acceptance of the revised Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Saither operates, without regard to conflict of law principles. Any disputes arising from these Terms or the Service will be resolved through good-faith negotiation first, and if necessary, through binding arbitration or the courts of competent jurisdiction.
